Quick Answer
If you received a complaint captioned Province Fiduciary Services, LLC, solely in its capacity as Litigation Trustee of the CarePoint Litigation Trust v. [your company], or a complaint from Garden State Healthcare Associates, LLC or New Jersey Medical and Health Associates, LLC, you have been sued in the U.S. Bankruptcy Court for the District of Delaware. Your answer is generally due 30 days after the summons was issued. The “summons served due date” on the docket, January 28, 2027 for many trust cases, is the plaintiff’s deadline to serve you, not your deadline to answer.
Sued in the CarePoint bankruptcy? Call (302) 214-0777 today. Complaints were filed beginning October 30, 2026, so many answers may be due as early as late November or early December 2026. We offer a free, no-obligation consultation and can confirm your exact deadline the same day.
The Case Behind the Complaint
The lawsuits arise from In re CarePoint Health Systems Inc. d/b/a Just Health Foundation, et al., Case No. 24-12534 (JKS), the Chapter 11 case of the company that operated Bayonne Medical Center, Christ Hospital and Hoboken University Medical Center in New Jersey. The debtors filed in Wilmington on November 3, 2024. All of the cases are before Judge J. Kate Stickles.
CarePoint’s plan was confirmed on April 17, 2025 and became effective on May 22, 2025, for all debtors except the two Practice Group Debtors. The plan created the CarePoint Litigation Trust, with Province Fiduciary Services, LLC as Litigation Trustee. The trust is represented by Akerman LLP’s Wilmington office and the Law Offices of Mitchell J. Malzberg, LLC.
Why Some Defendants Were Sued Twice
The trust can only pursue claims of the debtors covered by the plan, and its complaints say they do not assert claims of the Practice Group Debtors. The Practice Group Debtors, Garden State Healthcare Associates, LLC and New Jersey Medical and Health Associates, LLC, remained in bankruptcy and filed their own lawsuits.
As a result, a vendor paid by both a hospital entity and a physician practice entity may face two lawsuits: one by the trust and one by a Practice Group Debtor. Each has its own adversary number, deadline and Exhibit A, and each must be answered.

The Intercompany Payment Claim
The trust’s complaints add an alternative fraudulent transfer count under 11 U.S.C. § 548. It targets payments that were prepayments, or payments by one CarePoint entity on a bill owed by a different CarePoint entity, without that entity giving reasonably equivalent value to the payor.
For healthcare vendors that served several hospitals under one account, this matters. Exhibit A lists which CarePoint entity made each payment, such as the Bayonne, Christ or Hoboken entity. Defendants should compare that with which entity actually received the goods or services.

Reading Your Papers
| Document | What it tells you |
| Summons | Your adversary number and the date the summons was issued, which starts the 30-day clock |
| Complaint | Usually preference (§ 547), alternative fraudulent transfer (§ 548), recovery (§ 550) and claim disallowance (§ 502(d) and (j)) |
| Exhibit A | Each payment, the paying CarePoint entity, invoice numbers and dates |
| Notice of Dispute Resolution Alternatives | Information about mediation and other ADR options in Delaware |
Your Response Options
- Ask for an extension before the deadline passes.
- Send a defense package with your own payment history, service dates and delivery records.
- File an answer. In Delaware, it must state whether you consent to the bankruptcy court entering final orders, under Local Rule 7008-1.
- File a motion challenging pleading defects or service.
- Use mediation, which the court offers through its ADR program and keeps confidential.
Doing nothing invites a default judgment for the full amount, plus interest and costs, and disallowance of any claim you hold against CarePoint.
The Trust’s New Value Figure Is Preliminary
The trust’s complaints state that it identified some potential subsequent new value from the debtors’ books, but that the figure is based on invoice dates and may change, because new value usually depends on shipping or service dates. They also say ordinary course information is largely in the defendant’s possession. A defendant’s own records are the starting point for reducing the claim.
Why Local Delaware Counsel Matters
A company must appear through a lawyer. Under Delaware Bankruptcy Local Rule 9010-1, a lawyer not admitted in Delaware must associate with Delaware counsel. Our Wilmington office at 1213 N. King Street appears directly in these cases, and our New Jersey roots mean we understand the Hudson County healthcare market these hospitals served.
